Privacy Policy Statement and Personal Information Collection Statement
Notice to Customers and Other Individuals Regarding the Personal Data (Privacy) Ordinance (the “Ordinance”)

1. Commitment to Privacy Protection   The Company is committed to complying with the provisions of the Personal Data (Privacy) Ordinance and, where possible, adhering to internationally recognized standards of personal data protection. To fulfill this commitment, we ensure that our staff strictly follow security and confidentiality protocols.

 

2. Definition of “Personal Data”   In this policy, the term “personal data” carries the meaning as defined under the Ordinance.


Company Policy

3. The Company ensures that all personal data collected, stored, transmitted, and/or used is handled in accordance with the responsibilities and requirements set out in the Ordinance. If an individual legally requests access to and/or correction of their personal data held by the Company, we will provide and/or correct such data within the time and manner prescribed by the Ordinance.

 

Collection of Personal Data

4. The Company may request customers to provide the following personal data (including updates from time to time) for the purpose of marketing, providing, registering, and managing products and services. Failure to provide such data may result in the inability to fulfill customer service requests.

 

5. Customers who are not registered YM members of the Company may browse the Company’s website as general visitors but may not be able to access all services and features available to registered members, including online ordering. To become a registered YM member, customers must provide personal data to access services such as receiving updates via email, responding to inquiries or feedback, and participating in Company events.

 

6. Non-YM members may purchase products from the Company. The Company will collect only the necessary personal data to fulfill the order (e.g., name, contact information, and payment/credit card details), but such customers will not be eligible for discounts/services/promotions.

 

7. References to “personal data” in this document include (but are not limited to):  
(a) Name, birth month and date, gender  
(b) Address, mailing address, phone number, fax number, email address, and identifiers for communication and social apps/software  
(c) Geographic location, website browsing behavior, and purchasing behavior  
(d) Payment details, including credit card and bank information with cardholder name  
(e) Identity verification data, including ID type and number, and documents with photo and name  
(f) Health status and medical history

 

8. In certain cases, customers may be asked to provide additional data to help improve products and services and/or provide tailored information. Customers may choose not to provide such data, but if the services are customized or require specific data, failure to provide it may prevent the Company from delivering the services. Such data may include (but is not limited to):   (a) Marital status   (b) Salary level and employment information   (c) Education level and occupation   (d) Information on previously used products and services   (e) Family information

 

9. Calls made to or received from the Company’s order/service/hotline or inquiry lines may be recorded for purposes including order tracking, quality control, and staff performance evaluation, management, and development. Unless otherwise stated during the call, such recordings are not considered personal data under the Ordinance, and callers have no statutory, contractual, or tortious rights to such data. The Company will ensure that recordings are not accessed unintentionally or without authorization.

 

Use of Personal Data

10. Customer personal data may be used for:  
- Identity verification  
- Providing products and services (including delivery and appointment services)  
- Processing shopping cart transactions  
- Following up on service applications, event participation, and order fulfillment (including membership verification and security checks)  
- Marketing and promotion (including by the Company, affiliates, and partners)  
- Improving products and services  
- Responding to inquiries  
- Verifying, executing, and processing payments  
- Managing account operations and collecting outstanding payments (including using collection agencies)  
- Maintaining, managing, and improving the membership system   - Analyzing and verifying customer data  
- Analyzing trends, usage, and purchasing behavior (based on individual or aggregated data) to better understand customer needs and improve services  
- Legal disclosures as required or permitted  
- Other uses agreed upon between the customer and the Company, including those stated in membership applications, order forms, or service appointment forms

 11. The Company will retain personal data only for the duration necessary to fulfill the original or directly related purpose unless otherwise required by applicable laws. After the retention period, personal data will be deleted from the Company’s systems. If legally required or permitted, the Company will retain only necessary data and will delete customer data within a reasonable time after account termination, including data held by third parties.

 

12. The Company will keep personal data confidential but may disclose it to the following parties for the purposes stated above:  
(a) Agents, contractors, or third-party service providers offering administrative, telecommunications, IT, payment, billing, mailing including SMS, delivery, or other services related to the Company’s operations  
(b) Individuals with confidentiality obligations to the Company, including affiliated companies  
(c) Persons to whom disclosure is required under binding or applicable laws, or under guidelines issued by statutory, regulatory, governmental, tax, law enforcement, or industry bodies, whether in Hong Kong or overseas  
(d) Actual or proposed assignees or participants in the Company’s rights  
(e) Any member of the Company’s group  
(f) Third-party service providers, insurers, credit card companies, product and service suppliers  
(g) Third-party reward, loyalty, co-branding, and promotional program providers  
(h) Co-branding partners as listed on relevant application forms  
(i) Charitable or non-profit organizations  
(j) Third-party service providers hired by the Company e.g., mailing, delivery, telecom, telemarketing, call centers, data processing, IT companies, regardless of location The Company may transfer customer data outside the Hong Kong SAR for the above purposes.

 

13. The Company may transfer anonymized and aggregated data to third parties, which may include anonymized customer data that cannot identify individuals.

 

14. If customers fail to provide personal data, the Company may be unable to provide full services.

 

15. Customers may provide third-party personal data e.g., recipient information. Customers agree they have obtained consent from the third party to provide such data to the Company for collection, use, and storage as described herein.

 

Website Data Collection Terms

16. The Company automatically collects data when customers browse or use the website, including browser type/version, operating system, IP address, and domain name, to compile server usage statistics and better meet customer needs. Customers under 18 are assumed to have informed their parents/guardians and obtained consent to be bound by these terms.

 

17. The Company uses features to assign unique identifiers to recognize customers across devices, treating such activity as a single user session.

 

18. Cookies may be installed on customers’ devices during website visits to personalize shopping experiences and services e.g., shopping cart management. Cookies are small files stored on hard drives and accepted by most browsers. They do not allow access to other parts of the computer or personal data. Customers may disable cookies via browser settings, but doing so may limit access to website features and services.

 

19. The Company uses reasonable physical, electronic, and managerial measures to protect personal data. While efforts are made to ensure security, no system can guarantee absolute safety. The Company uses industry-standard SSL encryption to protect data transmitted via its website.

 

20. This policy applies to the Company and its website, but not to third-party websites. Customers should review third-party privacy policies before submitting personal data. The Company is not responsible for third-party use or misuse of customer data.

Use of Data for Direct Marketing

21. The Company intends to use customer data for direct marketing and must obtain customer consent including non-objection. Please note:  

(a) The Company may use customer name, contact details, product/service information, transaction patterns, financial background, and statistics for direct marketing  

(b) Promotional categories include:  

   (i) Health, nutrition, wellness, beauty, skincare products and services  
   (ii) Reward, loyalty, and promotional programs  
   (iii) Services/products from co-branding partners as listed on application forms  
   (iv) Charitable or non-profit donations and sponsorships  

(c) These may be provided or promoted by:  

   (i) Company group members  
   (ii) Third-party service providers, insurers, credit card companies, suppliers  
   (iii) Reward, loyalty, co-branding program providers  
   (iv) Co-branding partners  
   (v) Charitable or non-profit organizations  

(d) The Company may also provide data to the above parties for marketing purposes, subject to customer consent  

(e) Marketing channels include but are not limited to:  

   (i) Phone calls  
   (ii) SMS including WhatsApp or similar apps  
   (iii) Postal mail  
   (iv) Email  

(f) The Company does not receive monetary or other compensation for providing data to others


22. Customers may opt out or re-subscribe to Company communications by emailing their registered name and membership number to: privacy@koa.com.hk

 

Access and Correction of Personal Data
23. Under the Ordinance, customers have the right to:  

(a) Check whether the Company holds their data and access it  
(b) Request correction of inaccurate data  
(c) Understand the Company’s data policies and the types of data held

 

24. The Company may charge a reasonable fee for processing access requests

 

25. Upon verifying the validity of access requests, the Company will respond within the time specified by the Ordinance
